Represented a consortium of leading international banks and investment funds, including Deutsche Bank, Merrill Lynch, and Goldman Sachs, in four years of litigation before Kazakh courts arising from a debt restructuring dispute worth hundreds of millions of US dollars. The case involved complex financial, contractual, and regulatory issues relating to the restructuring of a major financial institution’s debt obligations. The proceedings concluded with a favorable settlement for the consortium, safeguarding its financial and strategic interests in Kazakhstan.
Provided expert support to VakifBank, the second-largest bank in Türkiye, in JSC BTA Bank & Anor v. Türkiye Vakiflar Bankası TAO[2018] EWHC 835 (Comm), before the English High Court of Justice. The expert advice addressed complex cross-border restructuring issues involving the legal effects of debt restructuring in Kazakhstan, its recognition in the UK and Turkey, and the interaction between Kazakh restructuring procedures and English-law contracts. The work required detailed analysis of conflict of laws and the alteration of parties’ contractual rights through foreign insolvency mechanisms. The expert opinion supported the client’s successful challenge to the English court’s jurisdiction.
Represented the Royal Bank of Scotland (RBS) in the rehabilitation proceedings of a major Kazakh agricultural enterprise, successfully protecting the lender’s rights under a credit facility and related hedging transactions valued at over USD 20 million.
