Mukhit Yeleuov

About

    Mukhit Yeleuov has been ranked Band 1 by Chambers Asia-Pacific in eight editions since 2018, and as a Leading Individual by Legal 500 in nine editions since 2017.
    He is a co-founding partner of ADL Disputes and head of the firm’s Astana office, with over 20 years of experience as a disputes lawyer in Kazakhstan and Central Asia, particularly in the oil and gas, mining, and construction sectors. He was previously a partner and the head of the Central Asia dispute resolution practice at an international law firm.
    Mukhit holds a doctoral degree in law (S.J.D.) and acts as counsel in international arbitrations under the rules of the ICC, the International Arbitration Centre (“IAC”) of the Astana International Financial Centre (“AIFC”), Kazakhstan International Arbitrage (“KIA”), and other arbitral institutions. He also acts as counsel in the AIFC Court and in Kazakhstan’s courts up to the Supreme Court.
    He sits on the IAC’s panel of arbitrators and mediators and on the arbitrator panels of KIA and other institutions. He also acts as a Kazakh law expert before foreign and international tribunals.
    Mukhit is a former Board Member of the Kazakhstan Bar Association (KazBar). He is also a former co-chair of the KazBar’s Arbitration and Litigation Committee. He regularly speaks and writes on arbitration and civil procedure matters. Mukhit is fluent in English, Kazakh, and Russian, and speaks Turkish.

Experience

COMMERCIAL DISPUTES

Represented Qarmet JSC in the International Arbitration Centre (“IAC”) arbitration arising out of a multi-million-claim dollar under a supply contract with Oriental Rubber Industries Pvt. Ltd., an Indian producer of industrial equipment.

Defended Total Energies EP Danmark A/S in the Astana International Financial Centre (AIFC) Court against a multi-hundred-million-dollar claim arising out of a sale of shares in an oil and gas company.

Represented Freschette Limited, a foreign crypto mining company, in Kazakhstan International Arbitrage (KIA) arbitration arising out of a multi-million-dollar dispute under a crypto-mining contract with Enegix LLP, a Kazakh data center. The dispute was settled on favorable conditions.

Defended Kazphosphate Limited in the Astana International Financial Centre (AIFC) Court against a multi-million-dollar claim brought by Michael Wilson & Partners Limited, a law firm. The claim was dismissed on jurisdictional grounds.

Advised a LARGE KOREAN CONGLOMERATE in the Kazakhstan Supreme Court proceedings related to a multi-million-dollar sale of a subsidiary company and several land plots in Almaty.

Advised a GLOBAL OIL AND GAS COMPANY on a potential multimillion-dollar claim by its contractor arising out of a customs dispute involving the contractor.

Advised an OILFIELD SERVICES COMPANY in a dispute related to the recovery of leased equipment from a lessee.

Defended a LARGE SERVICES PROVIDER in Kazakhstan courts against a multi-million claim by a building owner arising out of a fire at a building leased from the owner. The claim was dismissed in full.

CONSTRUCTION DISPUTES

Advised a CONFIDENTIAL CLIENT involved in major property development projects in connection with a potential dispute arising from a multi-billion-KZT construction project in Kazakhstan. The matter involved complex issues concerning jurisdiction, governing law, the provision of security, corporate law issues under AIFC law and Kazakh law, and potential litigation and arbitration strategy.

Acted as a party-appointed Kazakh law expert in a Dubai-seated arbitration arising out of a multi-million-dollar dispute between a contractor and a subcontractor for the construction of the tallest building in Central Asia. The dispute centered on the interpretation of numerous provisions of a construction contract as well as Kazakh law provisions on construction contracts and the principle of good faith behavior.   The arbitration involved complex claims, counterclaims, and contract termination, with issues of contractual performance, notifications, etc.

Advised a BUILDING OWNER in a Dubai-seated arbitration arising out of a multi-million-dollar dispute between the owner and a contractor for the construction of the tallest building in Central Asia. The arbitration involved complex claims, and counterclaims, with issues of contractual performance, etc.

Represented a large contractor in a 200-million-dollar dispute related to alleged defects in construction work, attempted use of a guarantee for a defect notification period, and other issues.

Represented a large contractor in several multimillion-dollar disputes with several developers, a landowner, and the state registration authority.

Advised a subsidiary of a large oil and gas company on dispute resolution provisions of several multi-billion contracts with Kyrgyzstan and Tajikistan.

PROFESSIONAL MALPRACTICE DISPUTES

Advised a “BIG FOUR” AUDITING FIRM on a multimillion-dollar claim in an English court by a large Kazakh bank asserting a breach of contractual obligations and audit standards.

Defended a “BIG FOUR” AUDITING FIRM in a Kazakhstan court against a claim brought by a large state-owned industrial company asserting breach of contractual obligations and audit standards.

Advised a “BIG FOUR” AUDITING FIRM on an inspection by the Office of the Public Prosecutor related to an audit of a large bank.

Represented an INDIVIDUAL on a medical malpractice claim against a local clinic tried in Kazakhstan courts.

SHAREHOLDER DISPUTES

Advised and defended a mining company in two significant court disputes arising from claims to terminate the acquisition of 100% of the shares in a Kazakh LLP that is a gold mining company with rights to a major gold deposit.  The disputes raised complex substantive and procedural issues. 

Advised a LOCAL MINING COMPANY on potential claims and possible court and other actions against a current shareholder of a Kazakh company and its foreign creditor. 

Advised a LOCAL COMPANY on a potential complex shareholder dispute involving companies incorporated in the AIFC and Kazakhstan.  The matter involved a detailed assessment of multiple strategic and procedural options, including compulsory acquisition of shares, enforcement against shares in an AIFC company, director/CEO removal and disqualification, debt recovery, and potential insolvency-related measures.  The advice addressed complex issues of AIFC corporate law, shareholder rights, enforcement mechanisms and potential litigation strategy, including the assessment of the most viable routes for achieving the client’s objectives.

Advised a CONFIDENTIAL CLIENT in a high-value arbitration company under the International Chamber of Commerce (ICC) Arbitration Rules concerning a Kazakhstan oil-field development project.  The dispute arose from a shareholder disagreement over project financing obligations, management and development of the oil field, alleged failures to make required capital contributions, and the parties’ respective rights in the Kazakh project company.

Represented the interests of a CONFIDENTIAL CLIENT — a company’s owner in a dispute (with his relative and others) related to the “raider” seizure of a large industrial enterprise.
